Hire Agreement & Waiver

Below are the complete terms and conditions for all equipment hire from Rip Curl Ulladulla. By hiring from us, whether online or in-store, you agree to these terms.


Rip Curl Ulladulla - Hire Agreement & Waiver

This document constitutes a binding hire agreement between you, the Hirer, and Ulladulla Surf Shop Pty Ltd ("the Shop"). By signing or digitally accepting this document, you agree to all terms and conditions outlined below.


Section 1: Acknowledgement of Risk & Waiver of Liability

1.1. Assumption of Risk: The Hirer acknowledges that surfing, bodyboarding, and stand-up paddleboarding are inherently dangerous activities with associated risks. These risks include, but are not limited to, drowning, physical injury from marine life or the equipment itself, and the unpredictable forces of nature.

1.2. Hirer's Competency: The Hirer confirms that they can swim competently in an ocean environment and that they voluntarily assume all risks for themselves and for any members of their group under the age of 18 for whom they are the parent or legal guardian.

1.3. Waiver of Claims: The Hirer agrees to release, waive, and indemnify the Shop, its directors, and its employees from all claims for any injury, loss, or damage sustained by the Hirer or any third party as a result of using the hire equipment. This waiver extends to any claims of alleged negligence by the Shop.


Section 2: Equipment Responsibility & Security Deposit

2.1. Hirer's Responsibility: The Hirer accepts full financial responsibility for all equipment listed on the hire invoice from the time of pickup until the time of safe return to the Shop.

2.2. Security Deposit: A security deposit is required for all rentals to cover potential damage, loss, or theft.

  • For in-store hires, the deposit will be taken as a temporary pre-authorization hold on a valid credit card.
  • For online hires, the deposit will be processed as a full charge, which is then refunded after the equipment is returned safely.

2.3. Release/Refund of Deposit: The security deposit charge will be refunded, or the pre-authorization hold will be released, following the safe and timely return of all equipment in a clean, undamaged condition. Refunds and releases are processed by the Shop on Mondays and Fridays. The Hirer acknowledges that it may take their bank an additional 5-10 business days to clear the funds.

2.4. Authorization to Capture Funds: The Hirer expressly authorizes the Shop to retain all or part of the security deposit to cover any costs associated with the equipment being returned late, damaged, lost, or stolen, as per the fee schedule on the hire invoice.

2.5. Identification: The Hirer agrees to allow the Shop to record their photo identification (e.g., Driver's License) on file for the duration of the hire for security and verification purposes.


Section 3: Hire Period, Care & Returns

3.1. Hire Period: The standard hire period is 24 hours. Equipment is due back by the same time it was picked up on the following day.

3.2. Equipment Care: The Hirer agrees to take reasonable care of the equipment. Do not leave boards in direct sunlight on hot surfaces (e.g., sand or pavement) for extended periods.

3.3. Late Returns: Equipment returned after the agreed-upon time will be charged a late fee equivalent to the 24-hour rental rate for that item for each subsequent 24-hour period it is late.


Section 4: Legal Provisions

4.1. Governing Law: This agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.

4.2. Severability: If any part of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
